Terms and Conditions of Sale

Last updated 4 August 2026

Who we are

We are PicksArc Insights, LLC ("we", "us", or "our"), trading as On Paper Analytic, a company registered in the United States. These Terms and Conditions of Sale (our "Terms") form a legally binding agreement between you and us.

About our services

On Paper Analytic publishes statistical match projections for association football. Our model generates probability estimates for match outcomes across 17 European competitions, and each projection carries a clarity grade indicating how much historical data supports it.

We measure the accuracy of our projections against actual results and publish that record openly, including the competitions where our model performs poorly and for which we therefore publish nothing.

On Paper Analytic is an informational research service. We do not accept, place, or process bets or wagers of any kind, do not operate a gambling service, do not publish betting odds, and have no relationship with any bookmaker or gambling operator. Our projections are probabilistic and are frequently incorrect. Nothing we provide is advice of any kind.

The service is offered as a free tier and a paid subscription providing expanded access to projections and competition coverage.

Definitions

"Services" means services provided by us that link to these Terms, including our website and the content provided, generated, or made available through it (our "Materials"), and any services connected to or relying on Third-Party Services.

"You" means any individual using our Services, including anyone accessing our Services through your account ("Account") or with your authorisation.

"Using our Services" means interacting with our Services in any way, including creating an Account, making payments, accessing or browsing, or doing so through automated tools, scripts, or third-party applications.

Agreement to these terms

By using our Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms. If you do not agree, you may not use our Services.

Our Services are intended for users aged 18 or older, or above the age of majority in their jurisdiction, whichever is higher. If we become aware that a user is below the required age, we may suspend or terminate their access immediately.

By using our Services you confirm that:

  • you are at least 18 years old, or the age of majority where you live, whichever is higher
  • you have the legal capacity to enter into these Terms
  • the information you provide to us is, and will remain, accurate and current
  • you are not located in or subject to comprehensive sanctions, and are not a restricted party under applicable sanctions or export control lists

Conditions of use

By using our Services, you agree that you will not:

  • scrape, harvest, resell, redistribute, or create derivative commercial products from our projections, data, or Materials without our written permission
  • use our Services in breach of any law applicable to you, including gambling laws in your jurisdiction
  • attempt to gain unauthorised access to our systems, or interfere with the operation or security of our Services
  • misrepresent our projections as guarantees, predictions of certainty, or as advice of any kind
  • use our Services if you are under 18

Failure to comply may result in suspension or termination of your access, in addition to any other legal remedies available to us.

Changes to these terms

We may amend these Terms at any time. Non-material changes may take effect immediately. For material changes, we will provide reasonable notice and may require you to re-accept the Terms to continue using our Services. Changes required by law or by emergency may take effect immediately.

Your continued use of our Services after changes take effect constitutes your agreement to the revised Terms.

Your statutory rights

Nothing in these Terms limits, excludes, or modifies any mandatory rights, protections, or remedies you have under the laws that apply to you.

Right of withdrawal (EU, EEA and UK consumers)

If you are a consumer resident in the EU, EEA, or UK, you have a statutory right to withdraw from a contract within 14 days of entering into it, without giving a reason. This applies only to natural persons acting outside their trade, business, or profession.

Exceptions. The right does not apply to services fully performed with your prior express consent and acknowledgement that you would lose the right, or to digital content where performance began with your prior express consent and acknowledgement.

How to exercise it. Inform us by an unequivocal statement using the contact details at the end of these Terms. If the period expires on a non-working day, the deadline extends to the next working day.

Beginning service early. Where your subscription starts before the withdrawal period ends, we will ask for your express consent to begin and your acknowledgement that you will lose the right of withdrawal once the service is fully performed. If you cancel within the period after service has begun, you pay proportionally for the period used.

Effect. We will reimburse payments received, less any amount proportionate to services already provided, within 14 days of being informed, using the same payment method unless you agree otherwise.

Your account

You may need an Account to access all or part of our Services. Your credentials are for your personal use and your Account information must be accurate.

Our access. We may access your Account to provide or support our Services, investigate potential violations of these Terms, respond to legal requests, or protect the security of our Services.

Security. You are responsible for maintaining the security of your Account. You agree to use a strong, unique password, not to share your credentials, and to notify us immediately if you suspect unauthorised access. We are not liable for loss arising from your failure to meet these obligations — except where unauthorised access results from our own negligence or breach of our security obligations.

Deletion. You may delete your Account at any time through your Account settings or by contacting support. Outstanding payment obligations must be settled first. This does not affect your right to request deletion of your personal data under data protection law; we may retain data necessary to comply with legal obligations or to establish or defend legal claims.

Suspension and termination

We may suspend, terminate, or restrict your Account where, for example: your use poses a security risk; your use may expose us to liability or breach applicable law; your use is fraudulent, abusive, or illegal; you have not met payment obligations; you are in breach of these Terms; or we are required to act by a legal or public authority.

Where the issue can be remedied and immediate action is not necessary, we will give you notice and a reasonable opportunity to remedy it. We may act immediately where necessary, including in cases of fraud, security risk, or legal requirement.

On termination, licences granted to you end, outstanding payments become due, and we may delete your data in accordance with our Privacy Policy. Before permanent deletion we will give you at least 30 days to retrieve your data, unless immediate deletion is legally required. You may appeal by contacting us.

Pricing, taxes and fees

Prices are displayed in United States Dollars (USD) and are exclusive of sales tax where applicable. The total shown at checkout before you confirm is the full amount payable, including any charges we are required to collect.

If we discover an obvious pricing error before processing payment, we may correct it and inform you; you may then proceed at the correct price or cancel.

Payments

We accept Visa, Mastercard, American Express, and Discover.

Payments are processed by Stripe. By providing payment information you authorise Stripe to store and process it, authorise us to charge your selected method for the amount displayed at checkout and any recurring subscription fees, and confirm you are authorised to use that payment method.

We remain responsible for our contractual obligations to you regardless of who processes payment. For billing questions, contact us using the details below.

You must inform us promptly if your payment method is cancelled, your details change, or you become aware of unauthorised use. We may suspend access if payment is not successfully completed.

Refunds and cancellations

Subscriptions are billed in advance on a monthly or annual basis and renew automatically until cancelled.

You may cancel at any time from your account settings. Cancellation takes effect at the end of your current billing period, and you retain full access until that period ends. We do not pro-rate or refund partial periods.

First purchase. If you are dissatisfied with your first subscription payment, contact us within 14 days of that payment at support@onpaperanalytic.com and we will refund it in full, no explanation required.

Consumers in the EU and UK. Where you have a statutory right of withdrawal, that right is unaffected by these Terms and applies in addition to the refund period described above.

Renewals. Renewal payments are not refundable. We will email you before an annual subscription renews so that you have the opportunity to cancel beforehand. You can cancel at any time to prevent future charges.

Service interruption. If the service is materially unavailable for an extended period during a paid subscription, contact us and we will credit or refund the affected portion at our discretion.

Because On Paper Analytic provides informational research and not an outcome, refunds are not available on the basis that projections proved incorrect. Our projections are probabilistic and are frequently wrong — our published accuracy record shows how often.

Third-party services

Our Services rely on third-party providers, including Stripe (payments), Supabase (database and authentication), Vercel (hosting), and SportMonks (football data). By using our Services you agree to comply with the applicable terms of those providers where relevant.

We do not control these services and make no representations about them. Where an issue with our Services originates from a third-party provider, our responsibility is limited to using commercially reasonable efforts to resolve or mitigate the impact.

Service updates and availability

We may update, modify, or improve our Services at any time, including technical adjustments, security enhancements, feature changes, and adaptations required for legal compliance.

We will not make changes that materially reduce core functionality without a valid reason. If a change materially affects your use, we will notify you in advance unless the change is urgent for security or legal reasons. If you do not agree with such a change, you may stop using the Services and close your Account.

Our Services may occasionally be unavailable due to maintenance, technical issues, or circumstances beyond our reasonable control. Our Services may contain errors or interruptions.

Data

We handle personal information as described in our Privacy Policy. We do not use analytics tooling, do not track users across third-party websites, and do not sell personal information.

Statistical outputs generated by our model — projections, accuracy measurements, and aggregate competition data — are our own work product and contain no personal information. We may publish and use them freely.

Intellectual property

We retain sole ownership of all intellectual property rights in our Services and Materials, including our model, its outputs, and our published accuracy records. These rights are protected by international intellectual property law.

Subject to your compliance with these Terms and any payment obligations, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use our Services for your personal or internal business purposes. All rights not expressly granted are reserved.

If you publish or distribute materials taken from our Services, you must include reasonable attribution, such as a visible credit or link to our website. You may refer to our name factually, but must not use our name, logo, or brand assets in a way that implies endorsement or affiliation without our written consent.

Copyright infringement notices

If you believe your work has been reproduced on our Services in a way that constitutes copyright infringement, notify us with the following:

  • a signature of the person authorised to act on behalf of the copyright owner
  • a description of the copyrighted work you claim has been infringed
  • a description of where the allegedly infringing material is located
  • your address, telephone number, and email address
  • a statement that you have a good faith belief the use is not authorised by the copyright owner, its agent, or the law
  • a statement, made under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorised to act on their behalf

Under Section 512(f) of the Digital Millennium Copyright Act, anyone who knowingly materially misrepresents that material is infringing may be liable for damages.

Accuracy of materials

We aim to ensure information on our Services is accurate and current, but errors, inaccuracies, and omissions may occur, and we may correct them at any time. We make no warranty as to the accuracy or reliability of our Materials, or of any resources linked from our Services.

Accessibility

We are committed to making our Services accessible. We follow the Web Content Accessibility Guidelines (WCAG 2.2) level AA and are partially compliant, with ongoing work to remove remaining barriers.

As our Services evolve, new content may unintentionally introduce accessibility issues. If you encounter a barrier, please tell us using the contact details below — including the page, your device and any assistive technology, and a description of the problem. We will respond as quickly as we can.

Links to other sites

We may link to third-party websites for your convenience. We do not control, review, or endorse them, and we are not responsible for their content, availability, or accuracy. When you access a linked site you are leaving our platform, and different terms and privacy policies may apply.

Events outside our control

We are not liable for any failure or delay in performing our obligations caused by circumstances outside our reasonable control, including acts of God, natural disasters, internet outages, cyberattacks, strikes, and failures of third-party services. Affected obligations are suspended for the duration of the event.

Disclaimer of warranties

Our Services are provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties of any kind, express or implied, and disclaim all implied warranties including merchantability, satisfactory quality, fitness for a particular purpose, and non-infringement.

We do not warrant that our Services will be uninterrupted, error-free, timely, or secure; that they will meet your requirements; or that information available through them is accurate, complete, or reliable.

Limitation of liability

The following limitations apply to the maximum extent permitted by applicable law. Where a limitation is partially unenforceable, it applies to the extent that it is enforceable.

We will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, opportunity, savings, reputation, use, or data, arising out of these Terms or your use of (or inability to use) our Services — whether the claim is in contract, tort, breach of statutory duty, or otherwise, and even if we were advised of the possibility.

Our total aggregate liability arising out of these Terms or your use of our Services will not exceed the greater of (a) the total amounts you paid us in the 12 months immediately preceding the event giving rise to the claim, or (b) $100 USD.

Any claim arising out of these Terms or your use of our Services must be commenced within 1 year after the claim accrues, or it is permanently barred. Where applicable law does not permit this limitation, this clause does not apply to you.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be limited or excluded under applicable law.

Indemnification

You agree to indemnify and hold harmless our company, our affiliates, and our respective officers, directors, employees, agents, licensors, and suppliers from all claims, losses, damages, penalties, costs, and expenses (including reasonable legal fees) arising out of or related to: your use of our Services in breach of these Terms or applicable law; your violation of any third-party rights; your negligence, wilful misconduct, or fraud; and any security incidents resulting from your acts or omissions.

You will cooperate in the defence of any such claim at your own expense. We may assume exclusive defence and control of any matter subject to indemnification, in which case you agree to assist us. You may not settle any claim without our prior written consent. This obligation survives termination of these Terms.

Dispute resolution

Any disputes relating to these Terms or your use of our Services will be governed by the laws of the United States, without regard to conflict of law principles.

Before commencing litigation, you must give us written notice of the dispute using the contact details below, describing its nature and the relief sought. We will attempt to resolve it informally within 30 days. If it cannot be resolved in that period, either party may proceed with litigation.

Injunctive relief. We may seek injunctive relief against unauthorised use or abuse of our Services, unauthorised disclosure of confidential information, or intellectual property infringement, without first engaging in informal resolution.

Individual disputes only. To the extent permitted by law, you agree to resolve disputes on an individual basis and not as part of a class, representative, or consolidated action.

General

Severability. If any provision is found invalid or unenforceable, it is removed to the extent necessary and the remaining provisions stay in force.

Waiver. No waiver is effective unless made in writing. Our failure or delay in exercising a right does not waive it.

Entire agreement. These Terms, together with our Privacy Policy, form the agreement between you and us regarding our Services, and replace prior discussions on the same subject. Nothing here limits rights you have under consumer protection or data protection law.

Notices. Where written notice is required, email is sufficient unless the law requires otherwise. We may send notices to the email address associated with your Account; you are responsible for keeping it current.

Assignment. You may not transfer your rights or obligations without our written consent. We may transfer ours in connection with a merger, acquisition, or sale of assets, and will ensure your rights are not reduced as a result.

Interpretation. "Including" means "including but not limited to". The English (US) version of these Terms prevails over any translation. Headings are for convenience only.

Survival. Any provision that by its nature should survive termination will do so.
